When a property is auctioned off at a foreclosure sale, they are often auctioned off for more than what is owed on the lien that ultimately led to foreclosure.
For example,
A home that has a $150,000 lien on it, may sell for $200,000. The excess, or difference in the amount owed versus what the home was sold for, is called a “surplus.” In this example, the surplus recovery process would result in that difference being paid to the original owner of the otherwise, debt-free property (no other liens owing.)
A motion with supporting affidavits will need to be filed to seek entitlement to surplus funds. It is best to have an expert in the industry, research all avenues necessary and file in accordance to your county and state, as other creditors may try and claim partial ownership of funds really owed to you.
